Terms and conditions

These general conditions of sale govern the sale of products marketed by www.italianfarmfood.com. All contracts for the purchase of finished products, through the website www.italianfarmfood.com and according to the procedures indicated here, between the seller and the customer, will be governed by these General Conditions.

ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

  • The contract stipulated between Alba Società Agricola and the Customer must be considered concluded with the acceptance, even if only partial, of the order by Alba Società Agricola, which reserves the right, at its sole discretion, to accept the order. Acceptance is considered tacit, unless otherwise communicated in any manner to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the general conditions and payment transcribed below.
  • If the Customer is a final consumer (ie a physical person who buys the goods for purposes not related to his professional activity), once the online purchase process is completed, he will print or save an electronic copy and, in any case, keep the present general conditions of sale, in compliance with the provisions of Articles 3 and 4 of Legislative Decree n. 185/1999 on distance sales.
  • Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and / or property caused by the non-acceptance, even partial, of an order.

  • The conditions contained in this document may be modified by Alba Società Agricola without notice and will be valid from the date of publication on the website www.italianfarmfood.com

RIGHT OF WITHDRAWAL

  • Pursuant to articles 52 and ss. of the Consumer Code, the User who holds the status of Consumer has the right to withdraw from the purchase contract of the Product, without having to provide any reasons, without any penalty within 14 days from the date of receipt of the Product. The date shown on the delivery note proves full proof of receipt of the goods.
  • To exercise the right of withdrawal, the User must inform Alba Società Agricola, before the expiry date of the withdrawal period of his decision to withdraw. To this end, you can send any explicit declaration of your decision to withdraw from the contract by e-mail to info@italianfarmfood.com.
  • Upon receiving the notice of withdrawal, the Seller will send a confirmation e-mail to the Customer indicating the instructions for the return of the goods and attaching the label to be affixed to the packaging. In case of non-response, 24/48 hours after sending the communication of withdrawal, it will be necessary to request information via email (info@italianfarmfood.com) or by phone +39 035 335196
  • The Customer undertakes to return the purchased product, using a courier of his choice and at his own expense, within 14 days from the date of communication of withdrawal, appropriately protected and packed in the original packaging, accompanied by any accessories.
  • Pursuant to Article 56 c.2 of the Consumer Code, the User is solely responsible for the diminished value of the goods resulting from a handling of the product other than that necessary and the state of conservation of the non-normal product. The Product must in any case be kept, handled and inspected with the normal diligence and returned intact, complete in all its parts, with identification tags, labels and disposable seal, where present, still attached to the product intact and not tampered with, and perfectly suitable for its intended use and free of signs of wear or dirt. The withdrawal, moreover, is applied to the Product in its entirety, therefore it can not be exercised in relation to parts and / or accessories of the Product. If the serial number of the product is inserted on the product packaging, it constitutes part of the product and, consequently, the Product must be returned in the original packaging, which must be placed in a further package, not being able to affix it other label or ribbon. The shipment of the Product to the Seller, until the certificate of receipt in the warehouse of the same, is under the responsibility of the User, who will be required to pay compensation against the Seller in case of accident, except the responsibilities of the carrier. Therefore, in case of damage or loss of the goods being returned during transport, Alba Società Agricola will inform the Consumer about the event (within 5 working days from receipt of the goods), 
  • to allow the latter to promptly report a complaint against the carrier chosen by him and obtain a refund of the value of the asset (if insured)
  • In accordance with the provisions of art. 57 c.1 of the Consumer Code, only after receipt of the Product and after having positively verified compliance with the terms and conditions for the exercise of the right of withdrawal and the substantial integrity of the Product and the packaging and subject to any costs for the restoration of damage to the original packaging, the Seller will proceed, as soon as possible and in any case within 14 days from the date on which the Seller became aware of the exercise of the right of withdrawal, to the reimbursement of the sums paid by the Consumer. The amount of the refund will be communicated by e-mail and credited to the same means or payment solution used for the purchase, unless otherwise agreed.
  • In the event that the withdrawal has not been exercised in accordance with the provisions of applicable law, it will not result in termination of the contract and consequently will not give right to any reimbursement. Alba Società Agricola will inform the user by e-mail within 5 working days from receipt of the Product rejecting the withdrawal request. The Product will remain at Alba Agricola Company available to the user for collection, which must be at the expense and under the responsibility of the User.
  • Pursuant to art. 59, c.1 lett. c), d) and e) of the Consumer Code, the right of withdrawal is excluded if the sale relates to products tailored or customized or that by their nature can not be returned or are likely to deteriorate or expire rapidly .

GUARANTEES

  • In cases where the application of the guarantees provides for the return of the product, the goods must be returned by the customer in the original packaging, complete in all its parts (including packaging, etc.); to limit damage to the original packaging, it is recommended, when possible, to put it in a second box; in all cases, the affixing of labels or adhesive tapes directly onto the original packaging of the product should be avoided

APPLICABLE LEGISLATION AND COMPETENCE

Any dispute concerning the application, execution, interpretation and violation of the contract stipulated online by the Customer with Alba Società Agricola, is subject to Italian jurisdiction.

For any dispute between the parties regarding the contract, the Court of the place of residence or domicile of the Customer is competent, if located in the Italian territory (Article 14 paragraph 1 of the Decree); if the domicile of the customer or his residence is not within the Italian territory, the competent court is that of execution of the contract.
